Personal Subscription Agreement This Personal Subscription Agreement ("Agreement") sets forth the terms and conditions governing your right to access the Hannah Dawson Equine online archive service (the "Service"), through its website www.hannahdawsonequine.co.uk (the "Site") for a period of one year (annual payments) or for recurring monthly periods (monthly payments) from the date payment for your subscription has been successfully received through our secure online payment partner, PayPal. By completing the online personal subscription form and clicking the box "I have read and agree to the Personal Subscription Agreement" on the personal subscription registration page, and using the Service, you agree to be bound by all of the terms and conditions of this Agreement. This Agreement expressly incorporates by reference and includes the Site's general Terms and Conditions, Privacy Policy (see below) and any guidelines, rules or disclaimers that may be posted and updated on specific web pages, or on notices that are sent to you. In the event of any inconsistency between the terms of this Agreement and the general Terms and Conditions (see below), this document shall prevail. Please carefully review the terms of this Agreement before clicking the relevant check box on the online personal subscription registration form. If you do not wish to accept this Agreement, do not proceed with your subscription. Binding Terms and Changes Hannah Dawson Equine reserves the right to change the terms of this Agreement from time to time. Any changes to this Agreement will be posted on this web page. When the terms are changed, we will provide notice to you by email or by posting a notice on the site. Your continued use of the Service following such notice constitutes your acceptance of those changes. If you no longer agree to the terms of this Agreement or to any changes, please email us at support@hannahdawsonequine.co.uk immediately to cancel your subscription. Use of Site Content All personal subscribers are reminded that they must strictly adhere to our policy on Use of Site Content as contained in the Site’s general  Terms and Conditions (see below). Password Use and Security By entering into this Agreement, you acknowledge that the Service is for your exclusive use only. Use or sharing of your user name and password by another user is prohibited. Failure to comply will result in immediate suspension or termination of your account. You are solely responsible for maintaining the confidentiality of your user name and password and for all activities that occur under your user name and password. You agree to immediately notify us by email at support@hannahdawsonequine.co.uk if you become aware of or have reason to believe that there is any unauthorized use of your account or any other breach of security. We are in no way liable for any claims related to the use or misuse of your user name and password due to the activities of any third party outside of our control or due to your failure to maintain their confidentiality and security. Grant of License Hannah Dawson Equine grants you a non-transferable, non-exclusive and revocable license to use the Service according to the terms and conditions set forth in this Agreement. Except as expressly granted by this Agreement, you acquire no right, title or license in the Service or the content of any of the Site or other data or materials incorporated in the Service. Term and Termination Your access to the Service will continue from the date payment has been successfully received through our secure online payment partner, PayPal, unless it is terminated by Hannah Dawson Equine for any breach of this Agreement or any breach of the Site’s general Terms and Conditions (see below). Hannah Dawson Equine may discontinue or change the Service, or its availability to you, at any time without notice. Cancellation You can cancel online at any time by email to support@hannahdawsonequine.co.uk or letter to Hannah Dawson Equine. Cancellation takes effect from the end of your current billing period. Seven days notice of cancellation is required before the billing date to allow for processing. Cancellations made within seven days of the next billing date may be carried into the following billing period. Refunds are not given for partial use of a billing period paid for in advance. No Assignment THIS AGREEMENT IS PERSONAL TO YOU, AND YOU MAY NOT ASSIGN YOUR RIGHTS OR OBLIGATIONS TO ANYONE ELSE. No Waiver Neither failure nor delay on the part of any party to exercise any right, remedy, power or privilege hereunder nor course of dealing between the parties shall operate as a waiver thereof, or of the exercise of any other right, remedy, power or privilege. No term of this Agreement shall be deemed waived, and no breach consented to, unless such waiver or consent shall be in writing and signed by the party claimed to have waived or consented. No waiver of any rights or consent to any breaches shall constitute a waiver of any other rights or consent to any other breach. Severability If any provision in this Agreement is held invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The Courts of England and Wales are to have exclusive jurisdiction and venue for any dispute arising out of or in connection with the use of this Site.
